PACT Act Shipping Restrictions

The PACT Act, also known as the Vape Mail Ban, is going to go into full effect April 23rd.  The new changes to the PACT Act will restrict how the shipping of vape-related products is managed and regulated country-wide.

Here at Brand King, we have been doing the same as all of you – trying to navigate these changes and support our customers in the best possible manner while we find solutions. We have been searching for new small parcel carriers and working with LTL freight companies to find the best ways to get the product to our customers.

Unfortunately at this time, Brand King is not able to adapt to these new changes as quickly as we would like. This is due to the number of expensive and burdensome regulations overseen by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

 

How do I still do business with Brand King?

Shipping & Will Call options going forward

Effective April 22nd, 2021, Brand King will no longer be accepting online orders for vape-related products but we still offer a will call option at our Sacramento, California location for customers who are 21+ years old and have a business license on file. Certain LTL (Trucking Companies) will still be an option & offer freight delivery but this requires a larger order to justify a pallet being trucked as well as a California commercial business location in order to unload a pallet. About 5000pcs is where this option becomes about the same as it was previously shipping via UPS. The bottom line is for now the only options we can provide is shipping by truck within California or a will call pickup.

We highly recommend getting prepared, and placing orders for enough inventory to last for at least 2-3 months, if not longer, while we continue to navigate these new laws and find alternative shipping solutions.

It may also be wise to start considering other packaging options such as syringes, dropper bottles, and squeeze bottles, which we can still provide.

Do not worry, we will still be able to provide packaging solutions for all your needs. Tubes, Clamshells, and Boxes are still available for purchase and shipping.

 

A refresher on the PACT Act – What is it?

  • The Prevent All Cigarette Trafficking Act (PACT) was initially passed in 2009 to regulate the shipment of cigarettes and smokeless tobacco products.
  • The most recent changes occurred in December of 2020, and now includes Electronic Nicotine Delivery Systems (ENDS). These are defined as “Any electronic device that through an aerosolized solution delivers nicotine, flavor, or any other substance to the user inhaling from the device.”

 

ENDS includes the following types of products:

  • E-Cigarettes / E-Cigars / E-Hookahs
  • Vape Pens / Electronic Pipes
  • Advanced Refillable Personal Vaporizers
  • Vape Batteries / Mouthpieces / Atomizers / Replacement Parts

ENDS will now be treated like tobacco and tobacco products regarding shipping, resulting in strict bans from most shipping services and all ENDS distributors and retailers must be PACT compliant.
